I don’t remember the whole story Ramon. I assume you can look it up. But quite a few years ago Cracker Barrel was sued for discriminating against gay people. I just remember reading about it. Don’t recall the details….sorry.

On the converse, Yankee stadium doesn’t have an obligation to enforce a political act with chains. Both points are simplifications though. The issue is if baring people from leaving their rows during a public act of patriotism is overt and excessive and could be in possible violation of person’s civil rights.

I agree with this, however I think it’s an issue that best dealt with via pocketbook sanctions. I do want the police to be instructed to not get involved in enforcing GBA ejections. Eventually Hank’s lawyers will make him cut out the GBA stuff.

So is everyone giving Castillo all kinds of love today for starting the big rally last night?

  4. Comment posted by sheadenizen on August 30, 2008 at 5:44 pm (#824319)

The Cubbies are just allowing the Phils to take the lead so they can break their hearts in the 8th and 9th inning again……I hope!

If a restaurant refuses to serve black people or mentally handicapped, that’s a violation of civil rights.

No it isn’t. It’s a violation of the federal discrimination laws.

so you would fight the good fight if you were ever at yankee stadium, ramon?

Incidentally, notice Cracker Barrel faced no legal repercussions because they fired the LGBT employees. Discrimination based on sexual orientation is not yet codified in law

  10. Comment posted by Doc believes! on August 30, 2008 at 5:51 pm (#824323)

No it isn’t. It’s a violation of the federal discrimination laws.

In the first case the Civil Rights Act of 64 and in the second case the Americans with Disabilies Act.

Zod, I would never be caught dead in Yankee Stadium so question is moot.

But if by act of providence I am there, I wouldn’t start trouble during the song so not to disrupt the rest of the crowd. It isn’t fair to them to impose my own political beliefs in an obnoxious manner during the game just like it isn’t fair for the Steinbrenners to do the same. I would, however, go through appropriate channels to make my dissatisfaction heard.

I would most definately support someone if they wanted to take the issue to court though.

Of course this has nothing to do with the legal right of the Yankees to enforce rules during their events as long as the rules don’t violate anti-discrimination laws on the books.

My point is that it’s not a constitutional matter.

  14. Comment posted by Ramon on August 30, 2008 at 6:00 pm (#824326)

I think it is a constitutional issue. The act which the Yankees are enforcing pertain to an issue of political expression. Throwing someone out for walking during God Bless America isn’t the same as throwing them out for cursing, fighting or breaking other regular rules at most private establishments. Do most restaurants play God Bless America after the main course and then kick you out for leaving your table while it is played? The circumstances are rather unique to say the least…
